What is estate administration?

Estate administration can be described as the process whereby:

  • the assets of the person who has died are ascertained,
  • legal and tax obligations are fulfilled
  • assets are gathered in or transferred
  • liabilities are paid
  • the remaining estate is distributed to those entitled to benefit (beneficiaries).


What you need to think about when Administering an Estate

In order to Administer an estate, there are a few key things you will need to consider.

Who will administer the estate?

If there is a Will, it will name executors to administer the estate. If there is no Will, Government rules will apply to say who should deal with the administration of the estate (administrators) and who will be entitled to inherit. The term “personal representatives” is often used to describe both these roles.

Getting a Grant of Representation

In many cases, personal representatives will need to obtain a grant of representation (Probate or if there is no Will Letters of Administration) issued by the Probate Registry of the High Court to confirm their authority so that assets can be dealt with.

Is Tax involved?

Estate administration often involves Inheritance tax, Capital Gains tax and Income tax issues that can seem daunting.
